Immigration status to qualify for the Marketplace

Important update for DACA recipients & consumers with certain other immigration statuses

Due to a court order issued on December 9, 2024, Deferred Action for Childhood Arrivals (DACA) recipients and consumers with certain other immigration statuses listed below are no longer eligible for Marketplace coverage if they live in these states: Alabama, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Kentucky, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Carolina, South Dakota, Tennessee, Texas, and Virginia. 

Don’t select "yes" to the application question that asks if you have eligible immigration status if: 

  • You live in one of those states and were granted Deferred Action Status as a Deferred Action for Childhood Arrivals (DACA) recipient 
  • You live in one of those states and have one of these specific immigration statuses or authorities:
    • Non-citizens with certain approved employment-based immigrant visa petitions who are transitioning from an employment-based nonimmigrant status to lawful permanent resident (LPR) status and their spouses and children, for who immigrant visa numbers are not yet available
    • Family Unity beneficiary under section 1504 of the Legal Immigration and Family Equity (LIFE) Act Amendments
    • Adjustment to lawful permanent resident (LPR/Green Card holder) status without an approved immigrant visa petition
    • Special Immigrant Juvenile (SIJ) Classification who only have an approved petition for SIJ (and do not have an application pending for adjustment of status)
    • Children under age 14 with a pending application waiting period for asylum, for Withholding of Deportation or Withholding for Removal under the immigration laws or under the Convention against Torture (CAT), whose application has been pending for fewer than 180 days

Health coverage through the Marketplace will end If you live in one of the states and have one of the immigration statuses or authorities listed above. You might be able get health care at a lower cost through a community health center. They provide primary care services on a sliding scale based on your income.

DACA recipients and consumers with certain other immigration statuses who don't live in one of those states aren't affected. Get list of states where you may be eligible for Marketplace coverage.

  • Paroled into the U.S.
  • Granted an employment authorization document (EAD), also called a work permit or I-766
  • Individual with Non-immigrant Status includes workers visas (such as H1, H-2A, H-2B), student visas, U-visa, T-visa, and other visas
  • Deferred Action Status, including Deferred Action for Childhood Arrivals (DACA) recipients
  • Cuban/Haitian entrant
  • Conditional entrant granted before 1980
  • Battered spouse, child or parent 
  • Victim of Trafficking and their spouse, child, sibling, or parent 
  • Special Immigrant Visa holders from Iraq or Afghanistan 
  • Granted Withholding of Deportation or Withholding of Removal, under the immigration laws or under the Convention against Torture (CAT)
  • Violence Against Women Act (VAWA) Self-Petitioners
  • Member of a federally-recognized Indian tribe or American Indian born in Canada
  • Citizens of the Marshall Islands, Micronesia, and Palau who are living in one of the U.S. states or territories (referred to as Compact of Free Association, or COFA migrants)
  • Lawful Temporary Resident
  • Temporary Protected Status (TPS)
  • Deferred Enforced Departure (DED)
  • Special Immigrant Juvenile Classification
  • Family Unity beneficiary, including those who are under section 1504 of the Legal Immigration and Family Equity (LIFE) Act Amendments
Applicant for certain statuses
  • Adjustment to Lawful Permanent Resident (LPR/Green Card holder) status
  • Special Immigrant Juvenile Classification
  • Victim of Trafficking Visa
  • Children under 14 with a pending application for asylum, for Withholding of Deportation or Withholding for Removal under the immigration laws or under the Convention against Torture (CAT)

We only use your information about immigration status to check if you qualify for Marketplace coverage. We don't use it for immigration enforcement.
