A dependent is a family member in the employee’s household who is eligible for coverage, like a spouse, child, or partner.

Are employers required to cover dependents?

In most states, employers can decide if they want to cover dependents or contribute to dependent coverage.

Who is considered a dependent?

Other adult dependents may be a parent, a disabled adult child, or other adult, depending on state law and employer choices. State laws and insurance company policies may determine who else can be added to an employee’s coverage. Employers may have a choice about offering coverage to domestic partners.

Can a dependent get coverage through the Marketplace?

If you offer coverage to the employee that meets affordability requirements (the cost of employee-only coverage doesn’t exceed 9.5% of the employee’s income) and the coverage includes dependents, the dependents can choose to accept the coverage offer or get coverage elsewhere. If the dependents decline the offer of coverage, they can buy coverage through the Health Insurance Marketplace®, but won’t be eligible for a premium tax credit or cost-sharing reduction, regardless of income level.
